  美國唱片業協會（RIAA）控告Napster公司的侵權官司美國法院原先的命令是, 自美西時間2000/7/28午夜(臺灣時間29日下午三時)起, Napster必須停止讓網友下載或交換有著作權的音樂。聯邦第九上訴法庭卻於周五裁定，Napster暫時仍可繼續音樂交換服務，暫緩執行周三由地方法院Patel所下的關閉服務禁制令。

  在舊金山聯邦地方法院舉行聽證會，法官Marilyn Patel初步裁決Napster「創造了怪獸」，必須停止讓網友再繼續下載或交換有著作權保護的MP3音樂。這道禁令將從週五凌晨零時起生效。
